In the fall of the same year he performed garrison duty at Fort Edward and Fort Ann, and in the summer of 1777 he was at Fort Edward. He served -- mths during Schuyler's retreat, after which he was taken sick and permitted to return home. In 1778 he performed garrison duty at the Schoharie Forts and later went on several tours in pursuit of Tories. A pensioner under the Act of June 7, 1832." I Ahasuerus W Van Patten being mindful of my mortality + being weak in body, but of sound mind good memory blessed be Almighty God for the same do make and publish this my last will and Testament in manner and form following that is to say
First I give devise and bequeath unto my dear wife Sarah Van Patten during her natural life (in case she remains my widow) the use and income of all my real and personal estate to be used and applied by her for the following purposes. First for the support and maintenance of my ten children and the education and schooling of them until they become of age giving to each of them the same and equal advantages as the others and for her own maintenance and support and secondly to pay off and discharge all my just debts + personal charges, hereby giving her this full and absolute control and management of the same until my youngest child shall become of age for the purposes aforesaid with the power to sell the real or personal estate for the purposes of paying my debts in case she cannot otherwise as well manage the said property, which bequest above given is to be complied by my said wife in lieu of Dower and subject to the herein after made.
Secondly After the death of my said wife I give devise and bequeath unto my children Mary Ann wife of Nicholas Swart, Jacob Van Patten, Simon A. Van Patten, Elizabeth Van Patten, Rebecca Van Patten, Ahasuerus W. Van Patten Junior, Jemima Van Patten, William Van Patten, Cornelius James Van Dyck Van Patten, Staats Zekiel Van Santvoord Van Patten or the survivors and the heirs of such as may die all my said estate real and personal to be equally divided unto as many fractions as there shall be children living or dead leaving heirs.
Thirdly I give and bequeath unto my son Ahasuerus W. Van Patten Junior my suit of black___ cloth coat vest and Pantaloons for his named sake.
Fourthly In case my said wife shall die before my youngest child shall become of age or in case she shall marry before that time then my will is in case of her death that my property shall be managed in the same manner by ____ _____ Executor hereinafter appointed and in case of her marriage then that she shall be entitled to one third of the rents and property of the said Estate instead of the whole as firstly provided the remainder to go equally to the children.
Fifthly It is my will that my five youngest children learn some mechanics trade + I do hereby appoint my Executors or the survivor of them guardians for the purpose of binding or otherwise putting? them to trades at such times as they should think proper.
And lastly I do hereby appoint my said wife Sarah Van Patten + my friend and cousin Simon P. Van Patten executors of my Last Will and Testament revoking all former wills.
In testimony whereof I have hereto set my hand + seal this tenth day of August in the year of our Lord One Thousand and Eight Hundred + Thirty Seven
